Proposed CC&R Amendment 

Very soon, you will have the opportunity to vote on a proposed amendment to the Quail Creek Covenants, Conditions, and Restrictions (CC&Rs). The proposed amendment will establish a fee, called the Community Improvement Fee (CIF). The fee will provide additional funding for homeowner-desired improvements, as well as, a minimum of 10 years of supplemental funding for the Reserve fund. The fee will be equal to one year’s annual POA dues and will be assessed to the new owner upon the purchase of an existing home.  

As a Quail Creek homeowner, you have the opportunity to participate in deciding on this important issue for your community.  Before you cast your ballot for or against the amendment, we encourage you to read the amendment in its entirety and do your due diligence by researching and investigating the facts. Whatever you decide, please vote so that we can hear from everyone on this issue.

Voting on the Amendment

This voting will done electronically. An emailed invitation to vote was sent to all homeowners in Quail Creek who have an email address in their POA records on Monday, February 4, 2019. Each household has one vote, no matter how many homeowners share the property. Homeowners who own more than one property may cast one vote for each of their properties. The electronic voting system weights the votes by the number of properties owned, so a homeowner who owns two properties will have their vote multiplied by two. If there is no email on file for a homeowner, a ballot package will be sent by US mail in on Monday, February 4th. If a homeowner receives an email for electronic voting, but would prefer to vote by paper ballot, they may contact the Administration office and receive a paper ballot instead. Paper ballots may be returned in the enclosed reply envelope or dropped in the ballot box at the Madera Clubhouse kiosk.

Voting will continue through April 1, 2019 at 4 PM, close of business.

In addition to the initial mailing of paper ballots, duplicate paper ballots may be obtained by contacting Debbie Deptula, POA Admin Assistant, at, to set up a day/time to obtain a replacement paper ballot package. For identification purposes a Robson card and another form of picture ID will be required when picking up a replacement paper ballot.

About the Community Improvement Fee

Most Robson Communities, Inc. (RCI) communities have amended their CC&Rs to add a resale buyer’s fee of some kind to help fund future expenditures. However, most have had to wait until after transition, which occurs after all the new homes have been built, and they are no longer under the developer’s control.  The developer is providing Quail Creek with the opportunity to change their CC&Rs now, instead of waiting until after transition, to include the same verbiage that would typically be incorporated after transition. This would allow the POA to begin collecting funds now instead of waiting until after transition. Establishing the fee now will help maintain the financial stability of Quail Creek, which is essential to maintaining property values.

Many homeowners have asked to have another vote on this issue in light of the results of the 2018 Reserve study.  That study recommended homeowner dues increases of $15/month for 2019 and $10 per month in 2020.  Additional dues increases will be necessary in the future for capital improvements that are not specifically covered by the Reserve fund. Every dollar collected through this fee is a dollar homeowners will not pay in increased dues or special assessments
